DMCA Copyright Infringement Notification.
WhatsApp Plus respects the intellectual property rights of others. Pursuant to the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) (DMCA), we have adopted the following policy regarding copyright infringement.
We reserve the right to block access to or remove material that we believe in good faith is copyrighted and has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members or users, and to remove and suspend service to repeat infringers.
Procedure for Notifying Copyright Infringement: If you believe that material or content residing on or accessible through our website infringes your copyright, please send a notice of copyright infringement containing the following information to our Designated Copyright Agent:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is alleged to have been infringed.
- Identification of the works or materials that are the subject of the infringement.
- Identification of the material claimed to be infringing, including its location, with sufficient detail to enable us to find and verify its existence.
- Contact information about the notifier, including address, telephone number and, if available, e-mail address.
- A statement that the notifier has a good-faith belief that the material is not authorized by the copyright owner, its agent or the law.
- A statement under penalty of perjury that the information provided is accurate and that the notifying party is authorized to file the complaint on behalf of the copyright owner.
- A physical or electronic signature of the copyright owner or of a person authorized to act on his behalf.
Send written notice of copyright infringement:
[Name and contact information of the designated copyright agent].
We may notify our users of any notice of withdrawal by means reasonably calculated to notify the user. For example, we may post a notice on our website.
Counter-notification: If a notice of copyright infringement has been wrongly filed against you, you may submit a counter-notification to our agent. A valid counter-notification is a written communication that incorporates the following elements:
- A physical or electronic signature of the poster.
- Identification of the material that has been removed or to which access has been prevented and the location where the material appeared before it was removed or access to it was prevented.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or rendered unusable as a result of mistake or misidentification.
- Your name, address and telephone number; a statement that you consent to submit to the jurisdiction of the federal court for the judicial district in which your domicile is located or, if your domicile is outside the U.S., for any judicial district in which the service provider may be located; and that you agree to accept service from the plaintiff.
- The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the material referenced was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”.
When we receive a valid counter-notification, we will forward it to the party who filed the original claim of copyright infringement. Please note that when we send a valid counter-notification to the complainant, a copy will be sent to the U.S. Copyright Office pursuant to 17 U.S.C. §512(g)(2).
Thereafter, the complainant must notify us within 10 business days that it has filed a lawsuit seeking a court order restraining the subscriber from engaging in infringing activity relating to the material on our network. If we receive such notice, we will stop allowing access to the material. If we do not receive such notice, we may resume access to the material.
Modifications: We reserve the right to modify this policy at any time. Changes will be effective immediately upon posting on our website. Material submitted prior to the changes will not be affected.
